New North Carolina Law Tilts the Scales of Justice in Favor of Insurance Companies

House Bill 542, aka the “Billed vs. Paid Law,” went into effect in October of 2011.  The law requires personal injury victims to disclose the medical expenses paid by their health insurance companies. 

The Law may give insurance companies yet another upper hand by allowing their defense attorneys to argue that a jury should only have to compensate injured citizens for  the out-of-pocket medical expenses paid.  Insurance companies already benefit from pure contributory negligence; meaning that if a judge finds the personal injury victim even 1% at fault for their injuries they are barred from recovering any compensation.
